How to obtain the Portuguese nationality?

Under the Nationality Law you may find several possible ways of attribution/acquisition of Portuguese nationality:
  • Attribution of nationality (original nationality) – the case of Portuguese of origin; 
  • Acquisition of nationality (derivative nationality):
  • By effects of willingness:
  • Underage or disabled children of father or mother that acquire Portuguese nationality;  
  • In case of consensual union with a national Portuguese;
  • In case of those that have lost the Portuguese nationality during incapability; 
  • By adoption;
  • By naturalization.
The following are Portuguese of origin:
  • The child of Portuguese mother or Portuguese father born in the national territory;  
  • The children of Portuguese mother or Portuguese father born abroad, if the Portuguese parent lives there servicing the Portuguese State;
  • The children of Portuguese mother or Portuguese father born abroad  if their birth is registered in the Portuguese civil registry or declare that want to be Portuguese;
  • The individuals born in Portuguese territory, children of foreigner parents, if at least one of the parents have also born here and has his/her residence here, regardless the title, title length or time of birth;
  • The individuals born in Portuguese territory, children of foreigner parents, that are not servicing the respective State, if declare that they want to be Portuguese and considering that, since the moment of birth, one of the parents live here legally for at least 5 years;  The individuals born in Portuguese territory and that have no other nationality.
Yes, if he fulfils certain requirements.
 
If one of the child parent has Portuguese nationality while the child is underage the child may also have it. The law foresees that minor or incapable children of father or mother that have acquired Portuguese nationality they may also have it according to a declaration stating that they want to be Portuguese.
If none of the parents have or has obtained Portuguese nationality, the child cannot have the nationality. He/ she will have to wait until adulthood to request naturalization, if in the meantime all the respective requirements are verified.  
 
Yes, the new nationality law allows a foreigner to live in consensual union with a national Portuguese.
 
Yes. A foreigner married with a national Portuguese may acquire Portuguese nationality presenting a declaration for the effect. .
 
The fully adopted by a national Portuguese acquires Portuguese nationality. The process must be followed by proof of nationality of the adopter.
Note: the fully adoption is an adoption modality that is characterized by more exhaustive effects than other adoption modality, the restrict adoption. In the fully adoption the adopted acquire the situation of child of the adopter and integrates his/ her descendants, being extinguished the family bonds between the adopted and the original family.  
 
Being a child under 10 years old or a person that does not know how to write, read or speak, the proof of knowledge of the Portuguese language must be adequate to their capacity to acquire or show knowledge in the same language.
 
Yes, an opposition to acquire nationality may occur in cases of acquisition by willingness or via adoption.
 
In accordance to the article 15 of the Universal Declaration of the Human Rights nobody can be arbitrary deprived of his nationality, nor the right to change nationality. 
 
A person that has other nationality and does not want to be Portuguese must state it. If that statement is not made the Portuguese nationality is maintained. 
 
If there is on or more nationalities and one of them is Portuguese, only this one is relevant to the Portuguese law.
 
The Portuguese legislation allows pluri-nationality. However, the acquisition of Portuguese nationality may or may not mean the loss of the nationality of origin according to the laws of the country of origin, if they allow or not pluri-nationality thus are laws that demand that the individual renounce to his/ her previous nationality to obtain the nationality of the country of immigration. For example, the Ukrainian legislation does not accept the criteria of pluri-nationality.
