May be my request of concession of the «EU blue card» dismissed or cancelled?

Yes, your request may be dismissed or cancelled. The decisions of dismissal of concession or renewal as well as those of cancellation are notified, in written, to the respective recipient, or his/ her employers, indicating the respective grounds, the right to legal dispute and respective deadline.
The «EU blue card» may be dismissed in the following situations:
  • When the employer entity was penalized for the use of illegal activity of foreigner workers over the last five years; 
  • For reasons of public order, public security or public health.
The «EU blue card» is always cancelled whenever:
  • Was granted based on false or misleading declarations, false documentation, forged or altered or through the use of fraudulent means; 
  • If it is proven the practice of severe facts punishable by its holder or whenever there are strong evidence of that practice and that the holders intends to commit acts of that nature, namely, in the European Union territory;
  • If verified reasons of public order, public security or public health.
The decisions of dismissal of concession or renewal as well as those of cancellation are notified, in written, to the respective recipient, or his/ her employers, indicating the respective grounds, the right to legal dispute and respective deadline.
 
The cases of cancellation are competence of the member of the Government responsible for the area of internal administration, with the ability of delegate to the national director of SEF. In all the remaining cases, the national director of SEF has the ability to delegate.
 
The holder of the  «EU blue card», that has lived at least 18 months as holder of a  «EU blue card», in the member state that has granted it for the first time may come to Portugal with the purpose of perform an activity highly qualified and may come with his family members.
The request may be dismissed when the employer entity was penalized for the use of illegal activity of foreigner workers over the last five years and for reasons of public order, public security or public health.
This request may also be disapproved if the «EU blue card» issued by another member state has expired or was cancelled during the analyses of the request. 
 
In case of the dismissal of the request, and without prejudice of the hence exposed, the national citizen of a third state and his/ her employers entity are solidarity responsible for the expenses related to the return and readmission of the holder of the «blue car EU» and his/her family members.
When the request is dismisses because the employer entity was punished by the use of illegal activity of foreigner workers, over the last five years, the responsibility for the expenses mentions on the previous point is of the entire responsibility of the employer entity.
