I became unemployed. Which social support is available?

The unemployment benefit is a cash value that is paid each month to those who lost their jobs involuntarily, and is registered for use in the Job Centre or the Employment and Vocational Training Centres Employment Service (hereinafter Employment Service). The unemployment allowance is intended to compensate for the loss of labor remuneration. If you do not meet the conditions for receiving the Unemployment Benefit may be entitled to Social Benefit Initial unemployment.   • unskilled agricultural workers registered with the Social Security until December 31, 2010, in the case of their contributions have been calculated based on the actual salary;
  • ∙ Workers appointed to management positions since at the time of appointment, belong to the board of the company itself as contract workers for at least one year and framed the general system of social security of workers on behalf of others;
  • ∙ Workers contract which cumulatively are managers, partners or not, a non-profit entity, provided they do not receive the exercise of these functions any remuneration.
 
To be eligible to receive benefits you must:
Be resident in Portugal;
  • If it is foreign, have valid residence permit or other authorization that allows you to have an employment contract;
  • If you are a refugee or stateless person, have a valid title of temporary protection;
  • Have had a job with an employment contract;
  • Have been unemployed for reasons beyond their will (involuntary unemployment);
  • Not be working (if you work part-time as an employee by employee or as an independent, may be eligible for partial unemployment benefits since the remuneration for work for others or the relevant income from self-employment is lower than the value of unemployment benefits).
 
Note: The relevant annual income from self-employment, only for benefit calculation purposes, corresponds, as appropriate, 75% of the value of services rendered, or 15% of sales of goods and products as well as the supply of services effected within hotel activities and the like, food and beverage, earned in the previous calendar year.
 
You must also:
 
  • Be registered, in search of employment, nearest to you Employment Service;
  • Have the grant request within 90 days from the date of unemployment (see situations where the 90-day period may be extended);
  • To fulfill the warranty period - to be entitled to unemployment benefit must have worked as contracted and discounted in this capacity for social security or other compulsory social protection for at least 360 days in the 24 months immediately prior the date on which you became unemployed.
  • Count towards the qualifying period:
  • Every day he worked as a contractor;
  • The days worked in the month was fired;
  • The vacation days to which he was entitled and which were paid but were not taken;
  • The days you were receiving benefits from Social Security under the protection in sickness and in parenting, except for parental social allowances;
  • The days worked in a EU country, Iceland, Norway, Liechtenstein and Switzerland;
  • The days worked in countries with which Portugal has social security agreements, which allow account the added time in these countries to have access to Portuguese unemployment benefits;
  • Up to 120 days you were receiving a grant from the Social Security sickness or maternity, which has determined the registration fees for equivalence, if it is domestic or farm worker.
 
Workers who become unemployed, upon request of the unemployment Allowance, must register at the nearest Employment Service itself, making follow up with an identification document:
  • Identity Card or Citizen Card for Portuguese citizens;
  • Authorization to live and work in Portugal for citizens of countries outside the European Union, Iceland, Norway, Liechtenstein or Switzerland;
  • ID card or valid passport for citizens of the European Union and Fiscal Card.
It is also necessary to submit a statement of the employer that proves unemployment and indicates the date of the last payment (Model RP5044 / 2013-DGSS).
It can be delivered:
 
  • Directly by the employer through the Direct Social Security (only with employee's authorization, the employer must give a copy to the employee)
  • On paper by the employee at the Employment Service. If the employer refuses or fails to deliver the attestation of unemployment, in particular, the employer's death, will be the Authority for Working Conditions (former General Labour Inspection) to pass it within 30 days from the date on which the employee asks for it

To end the employment contract, you must give the employee the attestation of the duly completed unemployed (within 5 days from the date the worker to ask).
If you do not fulfill this obligation, you may pay a fine of € 250.00 to € 2,000.00 (or half of these values ​​if it is a company with 5 or fewer employees).
 
Any worker who becomes unemployed may apply for unemployment benefits. For this, you need to register at the Employment Service of your area.
A foreign citizen to enroll in the Employment Service must have their situation regularized in Portugal, namely:
  • Title valid residence or respective renewal application receipt; or
  • Another authorization allowing you to have an employment contract; or
  • A valid as a temporary protection if a refugee or stateless person..
 
If traveling abroad should notify the Employment Service within 5 working days from the date of the knowledge, communicating even how long it will be absent.
It should be noted that payment of unemployment benefit will be suspended if leaving the country with only a few exceptions:

 

  • If you leave the country in the annual period of leave or medical treatments, the need for which is certified under the terms established under the National Health Service (must notify the Employment Service that will leave);
  •  If you leave the country in duly proven volunteer mission, during the period of their assignment, up to a maximum of five years from the date of application for unemployment benefits.
  • If you leave the country as a fellow under the Community program, or promoted by other international institution, or as a research fellow for the stock duration of up to a maximum of five years from the date of the application unemployment benefit.
 
Having worked only five months, you are not entitled to unemployment benefits, but only to the Social Allowance Initial unemployment.
