I am going to invest in Portugal. How can I obtain a residency authorisation?

The new legal provisions give the possibility for foreigners investors to request a residency authorisation to the investment activity, to whom has a regular access to national territory, by making capital transfers, creating work places or buying properties. The holders of the Residency Authorisation to the Investment Activity have the right to the family reunification, access the permanent residency authorization, as well as to Portuguese nationality, in accordance with the current legislation.
The national citizens of third countries that hold an investment activity, in person or through a company that leads, generally, to the achievement, of at least one of the following situations in national territory for a minimum period of five years:
  • Capital transfer of an amount of €1 000 0000 or more;
  • Creating, at least, 30 work places;
  • Buying properties of an amount of €500 0000 or more.
 
Includes holders of a social capital company with head offices in Portugal or any country in de EU and with permanent address in Portugal, with the tax situation regulated.
 
There are three ways to request the residency authorisation:
  • Formulate the online request in www.sef.pt
  • Deliver the request at Portuguese Diplomatic Missions and Consular abroad;
  • Deliver the request at Regional Offices of the Foreigners and Borders Service.
  • Passport or other valid travelling document;
  • Proof of entry and legal stay in national territory;
  • Proof of health ensurance;
  • Application to check the Portuguese Criminal Record by the Foreigners and Borders Service;
  • Criminal Record Certificate from the native country or the country where you reside for more than one year;
  • Proof of the tax situation regulated by presenting an updated debt negative statement issued by the Tax and Customs Authority and Social Security.
The practice of investment activity for a minimum period of five years, attested by Solemn Declaration.
 
  • Show having made an investment of the minimum value requested, including stock investment or company shares.
  • Statement from an authorised financial institution for the practice of its activity in national territory attesting the active capital transfers, of an amount of €1 000 0000 or more, to the one or first capital holder, or  to stock acquisition or company shares;
  • Certificate of Commercial Registry updated that attest keeping social participation in the company.
Demonstrate having created 10 work places, making the workers register in social security and having an updated social security certificate.
 
  • Demonstrate to have properties.
  • Purchase deed or the purchase undertaking from the properties containing the statement of an authorised financial institution for the practice of its activity in national territory attesting the active capital transfers for its acquisition or to process the [...] promissory purchase and sale agreement of an amount of €500 0000 or more; and
  • An updated certificate from the Land Registry Office, in which must contain, in case of a promissory contract and whenever legally possible, the relative register.
  • The absence of conviction for a crime that in Portugal is punished by deprivation of liberty for more than one year;
  • Not being in the period of [...] prohibiting from entering national territory, following a removal order from the country;
  • The absence of indication in the Schengen Information System;
  • The absence of indication in the Integrated Information System do Foreigners and Borders Service for the purposes of refusing entry.
The holders of the Residency Authorisation to the Investment Activity can request family reunification the general law.
 
You might have to proof having fulfilled the following permanency periods:
  • 7 days, followed or not, in the first year;
  • 14 days, followed or not, in the next two year periods.
  Abroad you can obtain information in the Portuguese Diplomatic Missions and Consular and in the Agency for Investment and External Commerce of Portugal (AICEP).
