How to obtain a residence visa as an employee?

The grant of a residence visa in order to permit the holder to take up employment in Portugal depends on the existence of employment vacancies, which have not been filled by Portuguese nationals, nations of EU member states, nationals of the European Economic Area, nationals of third countries with which Portugal has signed a free movement agreement, and nationals of third countries, who are legally resident in Portugal.

For this purpose, the Council of Ministers, after hearing the Standing Committee for Social Dialogue, approves, annually, a resolution that defines a global quota indicative of employment opportunities, and can exclude sectors or activities where there is no need of manpower.

 

The IEFP keeps an updated information system, reachable to the public at the Internet, of the available job offers and discloses them at the Portuguese embassies and consular posts.

The embassies and consular posts access the available information at the Internet IEFP-site, publish the job offers at a proper place and disclose them, by diplomatic way at the competent services of the third country.

The third countries nationals who wish to occupy a job offer present their application to the address of the employer.

The employer send to the selected foreign citizen the labour contract or promised employment contract and the declaration issued by the IEFP proving that the job offer is covered by the quota and has not been filled by a worker who enjoys preference.

What kind of specific conditions must I meet to obtain a residence visa as an employee?
Apart from the above mentioned general conditions, you also must:
a) Have a labour contract or a promised employment contract; or
b) Have recognised education, competences or qualifications and adequate to the activity and benefit of an individualized expression of interest of the employer.
Holding a residence visa, can I see refused the authorization to live in Portugal?
Yes. The fact of having a residence visa does not mean that the SEF will grant to you, necessarily, the residence authorization. There are other conditions that must be met.
