May I be dismissed from presenting a visa of residence to obtain residence permit?

Yes, there are some situation to obtain temporary residence permit that need no visa of residence.
No need of visa of residence to obtain residence permit to foreigners that are in the following conditions: 
 
  • Minors, children of foreigner citizens holding residence permit born in the Portuguese territory;Minors, born in the national territory, that have remained here and are currently attending preschool education or basic education, high school or professional as well as their parents providing that they perform simultaneously parenting responsibilities, the requests may be submitted simultaneously;
  • Children of holder of residence permit that have reach the adulthood and that have remained frequently in the national territory since their 10 years of age;
  • Not minors born in the national territory and that have not leaved or have remained here before their 10 years of age;
  • Minors mandatorily subject to tutelage;
  • No longer benefit from the right of asylum in Portugal due to the fact that the reasons in which they have obtained the mention protection no longer exist;
  • Suffer from a disease that requires long medical assistance and that hamper their return to the country in order to avoid the put in risk his health;
  • Have finished the effective military service in the Portuguese Army Forces;
  • Have lost the Portuguese nationality, remained in the national territory over the last 15 years;  
  • Did not leave the national territory and the right of residence did not expired;
  • Have minor children resident in Portugal or with Portuguese nationality over whom they effectively perform parenting responsibilities and ensure their subsistence and education;
  • Are diplomatic agents or their respective partners, ascendants and descendants dependents, approved in Portugal during a period not less than 3 years;
  • Are or were victims of a severe of very sever penal infraction related to work and that means lack of social protection situation, salary and schedule exploitation, evidences proved by the the Authority for the Work Conditions (ACT) provided that they did report the infraction to the competent entities and cooperate with them;
  • Have benefited from residence authorization granted because they were victims of human traffic or support to illegal immigration;
  • That have benefited from the residence autority to study granted under the articles 91 and 92 and once finished their studies want to perform in the national territory a professional activity, subordinated or independent, except when that was issued in the scope of agreement so cooperation and are no strong reasons to the national interest that justify them;  
  • Have benefited from a visa of temporary entrance to perform an investigation activity or highly qualified, want to practice an investigation activity, a lecturer activity at an university or highly qualified, subordinated or independent;
  • That prove investment activity in the terms of the points d) of the article 3.
